1. Acceptance of Terms

Welcome to Zain! By downloading, installing, accessing, or using the Zain mobile application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Zain ("we," "us," or "our").

If you do not agree to these Terms, please do not use the Service. Your continued use of the Service constitutes your acceptance of these Terms and any updates to them.

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

To use the Service, you must:

• Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, if higher)
• If you are between 13 and 18 years old (or the age of majority in your jurisdiction), have your parent or guardian's consent to use the Service
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account credentials with others
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe may compromise the security of the Service.

4. Description of Service

Zain is a personal growth and productivity application that helps users:

• Track and build habits
• Log reading progress and manage book collections
• Write journal entries and notes
• Track prayer times and spiritual practices
• Connect with friends and participate in challenges
• Sync with fitness devices and health apps
• Gain insights through analytics and pattern recognition

Features may vary based on your subscription plan and device capabilities. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

5. Subscription Plans and Payments

5.1 Free and Pro Plans

Zain offers both free and paid subscription plans:

• Free Plan: Provides access to basic features with certain limitations
• Pro Plan: Provides access to all features without limitations, available as monthly or yearly subscriptions

5.2 Free Trial

We may offer a free trial period for the Pro Plan. During the free trial:

• You will have full access to Pro features
• No payment is charged during the trial period
• You will receive a reminder before the trial ends
• At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends

5.3 Billing and Payments

• Subscription payments are processed through Apple App Store (iOS) or Google Play Store (Android)
• You will be charged at the beginning of each billing period (monthly or yearly)
• Prices are displayed in your local currency and may vary by region
• Prices are subject to change. We will provide notice of price changes before they take effect

5.4 Auto-Renewal

• Subscriptions automatically renew unless you cancel before the end of the current billing period
• Auto-renewal may be turned off at any time through your Apple ID or Google Play account settings
• Cancellation will take effect at the end of the current billing period

5.5 Refunds

Refund policies are governed by the Apple App Store and Google Play Store terms:

• For iOS: Contact Apple Support or request through your purchase history
• For Android: Contact Google Play Support or request through your purchase history

We do not have direct access to process refunds for subscriptions purchased through app stores.

6. User Content

6.1 Your Content

You retain ownership of content you create through the Service, including habits, notes, journal entries, posts, and other materials ("User Content"). By using the Service, you grant us a limited license to:

• Store, process, and display your User Content to provide the Service
• Create backups of your User Content
• Share your User Content with other users as directed by you (e.g., posts, challenges, book club content)

6.2 Content Standards

When sharing content with other users, you agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringes on intellectual property rights of others
• Contains personal information of others without their consent
• Contains malware, viruses, or harmful code
• Is spam or unsolicited promotional material
• Impersonates another person or entity
• Violates any applicable law or regulation

6.3 Content Moderation

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice. We may also suspend or terminate accounts that repeatedly violate content standards.

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated means (bots, scrapers, etc.) to access the Service
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the Service to harass, abuse, or harm others
• Collect or store personal information about other users without their consent
• Use the Service for any commercial purpose without our written consent
• Circumvent any technological measures we use to protect the Service

8. Intellectual Property

8.1 Our Rights

The Service, including but not limited to the App, website, design, text, graphics, logos, icons, images, audio clips, software, and all other content (excluding User Content), is owned by or licensed to Zain and is protected by copyright, trademark, and other intellectual property laws.

8.2 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device
• Access and use the Service for your personal, non-commercial purposes

This license does not include any right to resell, distribute, modify, or create derivative works from the Service.

8.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation to you.

9. Third-Party Services

The Service may integrate with or link to third-party services, including:

• Authentication providers (Apple, Google)
• Health and fitness platforms (Apple Health, Google Fit)
• Book data providers (Google Books)
• Payment processors (App Store, Google Play)

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimers

10.1 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10.2 No Medical Advice

The Service is not intended to provide medical, health, or fitness advice. Features such as habit tracking, prayer tracking, and fitness integration are for informational purposes only. Always consult qualified healthcare professionals for medical advice.

10.3 Data Accuracy

While we strive for accuracy, we do not guarantee the accuracy of prayer times, book information, or data from third-party integrations. You should verify important information independently.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE
• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Zain and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

13. Termination

13.1 By You

You may terminate your account at any time by:

• Deleting your account through the App settings
• Contacting us at support@thezainapp.com

Termination does not automatically cancel active subscriptions. You must separately cancel your subscription through your Apple ID or Google Play account.

13.2 By Us

We may suspend or terminate your account or access to the Service at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms.

13.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and User Content
• Sections of these Terms that by their nature should survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification)

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at support@thezainapp.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving your notice.

14.2 Governing Law

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

14.3 Arbitration Agreement

Any dispute arising from these Terms or the Service that cannot be resolved informally will be resolved through binding arbitration administered by [Arbitration Provider] in accordance with their rules. The arbitration will be conducted in [Your City, State/Country].

14.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

14.5 Exceptions

Nothing in this section prevents either party from seeking injunctive relief in court for claims related to intellectual property infringement or unauthorized access to the Service.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zain regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

15.6 Force Majeure

We will not be liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
